Negligent transfer
October 26, 2021Glenayce Abney, 89, lived at the Meadows at Shannondell skilled nursing facility. Her condition necessitated that she receive assistance from two staff members during transfers and activities of daily living. While being transferred from her wheelchair, Abney suffered a fractured right femur, which required surgery and caused her health to deteriorate. Approximately four months later, Abney died. She is survived by her two children.
Abney’s children, individually and on behalf of her estate, sued the facility and its affiliates, alleging negligent supervision, inadequate recordkeeping, and negligent failure to implement proper policies regarding transfers. Suit also alleged vicarious liability, ostensible agency, and corporate negligence, as well as wrongful death and survival claims.
The parties settled for $175,000.
