Improper supervision of resident

Sara Dardaris, a 31-year-old woman who suffered from intellectual disabilities, cerebral palsy, and other problems, lived in a community home operated by Delta Community Supports, Inc. Dardaris was allergic to certain foods, including grapes and strawberries, and required assistance in preparing food.

While at the community home, Dardaris allegedly choked to death on a peanut butter and jelly sandwich. She is survived by her father, who was contacted by a hospital but allegedly never received a call from or was offered any explanation from Delta Community Supports about his daughter’s death.

Dardaris’s father, individually and on behalf of her estate, filed suit against Delta Community Supports, CIBC Foundation, and David Whyer, its sole shareholder, alleging claims for professional liability, wrongful death, and survival. The plaintiffs asserted that the defendants failed to properly train the caregivers supervising Dardaris, provide food that was safe for her, and timely call for emergency help.

The parties settled for $750,000.
