Late diagnosis, treatment of epidural abscess
September/October 2022Doe, 54, was admitted to a hospital in the Chicago area. At the time of the admission, she was suffering from abdominal and back pain, and she subsequently experienced neurological symptoms, including progressive paralysis in her lower extremity, as well as bowel and bladder incontinence. She was transferred to another facility after four days and was then diagnosed as having a spinal epidural abscess. Despite surgery to drain the abscess, she suffered permanent injuries that resulted in continued incontinence and limited mobility.
Suit against two medical providers and the first hospital alleged failure to timely diagnose and treat the epidural abscess.
The parties settled for $6.4 million. The hospital paid $4.9 million, and the physicians paid the rest.
