Breach of contract
February 28, 2023Metro Urgent Care & Family Medical Center had a general liability policy with State Farm Fire & Casualty Co. After the building suffered roof and interior water damage during a windstorm, the facility presented a claim to State Farm. The insurer denied the claim after inspecting the premises. State Farm performed two more inspections after Metro Urgent Care retained counsel; however, the insurer again denied the claim, declaring the damage was not a covered event. Metro Urgent Care was unable to operate for approximately six months as a result of the denial and the ensuing repair costs.
Metro Urgent Care sued State Farm, claiming breach of contract and seeking damages for its repair costs to the roof and the facility’s interior.
The jury awarded more than $131,500.
