Negligent, contraindicated surgery
January/February 2023Susan Sprague, 64, suffered from Type 1 diabetes and high blood sugar. She underwent an elective first metatarsophalangeal joint arthroplasty with joint replacement and resurfacing, which was performed by podiatrist Daniel Bell. The surgery was unsuccessful, and Sprague developed an infection. This necessitated several more surgeries and left Sprague with permanent injury.
She sued Bell and his practice, alleging he negligently recommended and performed the elective surgery despite her high risk of infection and substantial risk of failure due to her age and medical condition. The plaintiff also asserted that the defendant failed to provide competent follow-up care.
The jury awarded $188,600 for the plaintiff’s pain and suffering.
