Negligent performance of colon resection
January/February 2023Vivian Warren underwent an open colon resection with anastomosis performed by general surgeon Daniel Fore. During the procedure, she suffered an injured left ureter, but this was not discovered until after the operation. Warren became critically ill, developing sepsis and cognitive impairment. She is now unable to stand or walk unassisted, among other things.
Warren sued Fore, alleging that he negligently cut her ureter during surgery and failed to recognize this during the procedure. The plaintiff also asserted that the defendant had failed to obtain informed consent and that he should have used ureteral stents and CT scan imaging during the surgery.
The jury awarded $250,000. The court denied the defendant’s posttrial motion.
