Resident falls in bathroom

January/February 2023

Doe, a 90-year-old woman suffering from Alzheimer’s disease, was admitted to a nursing home. At the time of her admission, she required assistance with mobility due to her muscle weakness, lethargy, and difficulty walking. At the home, Doe allegedly fell on at least six occasions but did not sustain injury. She later fell in the bathroom and suffered a fractured femur and a facial laceration. Following an open reduction internal fixation procedure, she was discharged to a rehabilitation facility.

Doe filed suit against the nursing home, alleging liability for her injuries.

The parties settled for $270,000.
