Forceful manipulation during CT scan
May/Jun 2023Tommie Thompson, 82, underwent a right shoulder replacement. Two months after the surgery, when he went to Radiology Associates for a CT scan of his chest, he apprised staff of his recent shoulder surgery. During the CT scan, however, a technician asked Thompson to place his hands above his head. The technician placed Thompson’s hands forcibly, causing him to suffer a full-thickness tear of the subscapularis tendon in his right shoulder. As a result, Thompson required additional shoulder surgery.
He and his wife sued Radiology Associates of Tallahassee, P.A., alleging its employee had forcibly manipulated Thompson’s arms, failed to respond to his complaints of pain and limitations, and failed to use alternative positions.
The jury awarded approximately $643,900.
