Failure to properly assess fall risk
November/December 2023Donald Lightcap, 70, was admitted to the Sanatoga Center skilled nursing facility while he was recovering from an infection. A day later, he fell from the toilet, fracturing his hip. He underwent surgery for his injuries.
The estate of Lightfoot, who subsequently died, sued the facility’s operator, alleging claims for wrongful death and survival. The plaintiff asserted that the defendant had failed to supervise Lightcap or properly assess his fall risk.
The parties settled for $175,000.
