Negligent forceps delivery

November/December 2023

Doe was admitted to a hospital in labor. She allegedly was administered Pitocin, and a forceps delivery was ordered to expedite the delivery after the fetal heart monitor showed tachycardia and decelerations. Approximately 17 hours after the delivery, the baby required extensive resuscitation. A CT scan revealed he had sustained a skull fracture and multiple intra- and extracranial hemorrhages. Now 8, he suffers from cerebral palsy.

Suit against the attending obstetrician, physician group, and hospital alleged negligent forceps delivery and liability under res ipsa loquitur.

The parties settled for $14.5 million.
