Failure to verify safe arrangements for sedated patient’s return home following procedure
September/October 2023Michael Steinway, who was in his late 60s to early 70s, underwent a cardiac catheterization procedure while under sedation at the John Cochran Veterans’ Affairs Medical Center. Within hours of the procedure, the facility allegedly discharged Steinway unaccompanied. He left the facility and attempted to drive home on his motorcycle. He passed out from the effects of the sedation, however, causing him to run off the road and crash.
Steinway suffered a head injury and multiple leg fractures. He was placed in a medical coma for several days and required extensive medical care. Steinway, who continues to suffer from numbness, pain, and constant swelling in his leg, missed three months of work from his job in the medical field.
He sued the United States, alleging the facility prematurely released him while he was under the influence of sedation and failed to verify that he had made safe arrangements for his trip home. The defense disputed causation, arguing that the police report noted that Steinway’s motorcycle had hit a rock before running off the road.
The parties settled for $780,000.
