Baclofen overdose
March/April 2025JL Merrill was admitted to the Emerald Care Center, where he allegedly received care from agents of Spectrum Healthcare Solutions PLLC. After he experienced an altered mental status, weakness, and hypotension, he was unable to complete dialysis. He later died of renal failure.
Merrill’s estate sued Emerald Care Center’s operator, Spectrum Healthcare Solutions, and two treating physicians, alleging that the defendants had given Merrill an overdose of Baclofen and that Spectrum was vicariously liable for the physicians’ actions and inactions.
The defense argued that Merrill had experienced renal failure before his short stay at Emerald Care Center. Spectrum also asserted that the physicians were independent contractors.
The parties settled for $258,000.
