Failure to inform patient, specialist of PSA test results

After experiencing bladder issues, 63-year-old George Yaros had a prostate specific antigen (PSA) test at St. Mary Medical Center. His PSA level was 21.05 ng/mL. The results were sent to Yaros’s primary care physician but not the specialist who ordered the test.

More than a year later, after he experienced bleeding and worsened symptoms, Yaros was diagnosed as having stage IV prostate cancer. He underwent surgery and chemotherapy and suffered organ failure. He now requires dialysis and has a poor prognosis.

Yaros and his wife sued St. Mary Medical Center, Inc., alleging medical negligence. The plaintiffs claimed that the blood test revealed cancer, but the results were never provided to him or sent to his specialist. Suit did not claim lost income.

The jury awarded $25.8 million, including $4 million to Yaros’s wife.
