Late Diagnosis of Bowel Perforation
November/December 2019Doe v. Roe Hosp., Confidential Dkt. No. (Confidential Jxn. and Ct. June 12, 2019).
Doe, 32, was taken to Roe hospital’s emergency room, suffering from abdominal distension, constipation, and discomfort. There was a high volume of patients in the emergency room, and Doe was brought to a hallway, where hospital nurses attended to him. Over the course of several hours, Doe’s symptoms worsened. Nurses administered a Fleet enema in response.
A subsequent CT scan revealed a bowel perforation. A surgeon deemed Doe’s condition inoperable, however, and he suffered septic shock before his death the next day. Suit against the hospital alleged failure to timely diagnose and treat the bowel perforation.
The parties settled for $950,000.
Plaintiff counsel: AAJ members Richard L. Nagle and Travis W. Markley, both of Reston, Va.
