Mishandled Shoulder Dystocia
November/December 2019Doe v. Roe Obstetrician, Confidential Dkt. No. (Va. Confidential Ct. Nov. 7, 2018).
During Doe’s delivery, shoulder dystocia was encountered. An obstetrician performed maneuvers to resolve the dystocia; however, Doe suffered a severe brachial plexus injury necessitating surgery to address nerve avulsion. The surgery was unsuccessful, and Doe now has partial lost use of his right arm and hand. Doe, through his guardian, sued the obstetrician, alleging mishandling of shoulder dystocia.
The parties settled for $1.1 million.
