Negligent Administration of Marcaine
March/April 2019Ferrell v. Cohen, No. 2017-001753-NH (Mich. Cir. Ct. Wayne Cnty. Oct. 5, 2018).
Karie Ferrell, 32, underwent placement of a crown over her first molar by dentist Jason Cohen. During the procedure, Cohen injected Ferrell with Marcaine to make her more comfortable. Ferrell complained of pain and numbness, and Cohen treated this by extracting the molar six days after the first procedure. An oral surgeon later diagnosed Ferrell as having suffered a traumatic inferior alveolar nerve injury. As a result, she has a reduced ability to chew, bite, and speak. Her injuries are permanent. She sued Cohen and his practice, alleging he negligently caused the nerve injury during the Marcaine injection.The jury awarded over $131,500, including $25,000 in past economic damages.
