Negligent Removal of Adult Molars

December 2018

Roe dentist referred Doe, 13, to an oral surgeon for extraction of several baby teeth. Roe’s staff member filled out the paperwork incorrectly, requesting extraction of Doe’s permanent first molars. As a result, the oral surgeon removed all four of Doe’s first molars. Doe now has large gaps between her teeth and will require future implants.

Doe sued Roe, the staff member, and the oral surgeon, alleging professional negligence. The defendants blamed one another for Doe’s injuries, with Roe and the staff member blaming the oral surgeon for failing to perform an independent assessment.

The parties settled for $700,000 during jury deliberations.
