Inadequate Lighting in Parking Lot

July 2019

Sandra Simms, a 48-year-old Comcast customer service representative, left work after completing a night shift. After exiting her office building to a rear parking lot, she tripped over a pothole while walking to her car. She suffered a fractured tibia, several ruptured ligaments, and a vascular injury. She required placement of a stent in her leg and has been unable to return to her job, at which she had earned over $41,300 annually, due to the severity of her injuries.

Simms claimed that the office building’s property management group failed to provide proper lighting in the rear parking lot, maintain the premises in a safe condition, and eliminate a dangerous condition.

The parties settled for $1 million before suit was filed.

Citation: Simms v. Partridge Equity Grp. I, LLC, settled before filing, Feb. 22, 2019.
