Wrongful termination, retaliation

June 2020

Jonathan Harris, a 31-year-old person of color, was hired by Herring Networks Inc., the parent company of One America News Network, a conservative San Diego-based cable channel. While working as a producer on a television show, he was subjected to racial comments and jokes, among other things. In addition, the television host treated him differently from his colleagues, including rejecting his ideas.

After complaining about a dispute that arose over a news segment concerning removal of Confederate monuments, Harris was fired. He had earned approximately $32,000 annually and did not obtain another job until seven months later, which required him to move.

Harris sued Herring Networks Inc., alleging wrongful termination, retaliation, and failure to prevent harassment.

The jury awarded more than $1.09 million, including $810,000 in punitive damages.

Citation: Harris v. One Am. News Network, No. 37-2018-00033996-CU-OE-CTL (Cal. Super. Ct. San Diego Cty. Feb. 6, 2020).
