Improper lookout
May 2020Carol Loevy, 59, entered an intersection in her SUV. Michael Tobin made a right turn in front of Loevy’s vehicle, and his pickup truck collided with her vehicle. Loevy suffered neck and lumbar spinal injuries, including a herniated disk at C5-6. She was later diagnosed as having radiculopathy in her extremities.
An artist earning $15 per hour, Loevy has not returned to work. Her medical expenses totaled $80,000.
Loevy sued Tobin, alleging failure to keep a proper lookout and yield the right of way. The defense conceded liability.
The jury awarded $200,000.
