Verdicts & Settlements: Motor Vehicle Liability
Mail truck collides with motorist
February 2021David Crimmins, 45, was driving his truck at approximately 40 mph through an intersection with two-way stop signs. Mail carrier John Boudreau stopped his truck at one of the stop signs and proceeded through the intersection, colliding with the passenger side of Crimmins’s vehicle.
Crimmins suffered a herniated disk at L4-5, which necessitated microdiskectomy surgery, physical therapy, and chiropractic care. He continues to suffer from pain that affects his ability to participate in his previous activities, including cycling, boating, and golfing; and affects his work as a commercial real estate developer. His medical expenses totaled approximately $67,400.
Crimmins sued the United States, alleging liability for Boudreau’s failure to yield the right-of-way.
The court awarded more than $1.3 million, including $25,000 for past and future loss of earning power.
