Improper lookout causes multi-vehicle collision

Reinaldo Cubillos, 35, was a passenger in a box truck stopped in traffic on a Florida highway. A log truck operated by Jesus Ajete Perez rear-ended the box truck, which then struck the back of a minivan. Cubillos suffered aggravation of a preexisting herniation at C5-6 and a Hill-Sachs lesion subsequent to a dislocated shoulder. He underwent physical therapy, arthroscopy, and surgical fusion surgery but continues to suffer from collision-related pain.

Cubillos sued Kevin SL Transport LLC, the log truck’s owner, and Perez, alleging improper lookout and negligence. Suit claimed undisclosed medical expenses but not lost income.

The parties settled for approximately $868,600.
