Failure to yield right-of-way
November 2021Jeffrey Newton, 52, was driving his motorcycle through an uncontrolled intersection when Steven Giambruno, who was driving a semi-truck as part of his employment with Freight Logistics, Inc., allegedly turned left in front of Newton. The two vehicles collided, and Newton was ejected from the motorcycle and landed on the pavement.
Newton sustained a fractured left hand, fractured ribs, and a pneumothorax. He underwent multiple surgeries and was later fitted for a hand prosthesis. His medical expenses totaled approximately $310,000.
An executive producer, Newton was unable to continue working due to reduced functioning in his left hand. He incurred an indeterminate amount of lost income.
Newton claimed Freight Logistics was liable for Giambruno’s failure to yield the right-of-way.
The parties settled for Freight Logistics’s $1 million policy limits.
