Failure to yield the right-of-way

November 2022

Patricia Carr, 61, was driving on a two-lane roadway when Jenny Jung Ah Yim’s vehicle turned left into a driveway and collided with Carr. As a result, Carr suffered a burst fracture at L2, which necessitated surgery.

A teacher earning approximately $70,000 annually, she was unable to return to work due to problems with walking and stability.

Carr sued Yim, alleging she negligently failed to yield the right-of-way.

The jury awarded Carr more than $6.2 million. Interest raised the award to over $7.2 million. A motion for attorney fees is pending.

Citation: Carr v. Yim, No. 2020-C-01545-2 (Ga. St. Ct. Gwinnett Cty. Mar. 25, 2022).

Plaintiff counsel: AAJ member J. Matthew Dwyer Jr. and James A. Neuberger, both of Atlanta.
