Driving under the influence

January 2023

Tiffany Horton, who was approximately eight months pregnant, was traveling on an Alabama highway when Irwin Francisco-Bartolo crossed the highway median and collided with Horton’s vehicle. Horton’s unborn child was severely injured and later died at a hospital.

Horton, on behalf of her unborn child, sued Francisco-Bartolo, alleging liability for the collision. The plaintiff claimed the defendant was under the influence of alcohol and driving without a license at the time of the crash.

The jury awarded $3.7 million.

Citation: Horton v. Francisco-Bartolo, No. CV-2016-902083 (Ala. Cir. Ct. Jefferson Cnty. Apr. 21, 2022).
