Failure to maintain adequate distance

Christopher Harvick, an employee of Harvick Hauling Services, was operating a Ram pickup, pulling a trailer on a northbound highway. While he was driving, the trailer collided with the left side of Genenisha Willis’s Mercedes. Willis, 35, suffered significant injuries plus aggravation of a preexisting condition. She underwent chiropractic care and surgery and incurred medical expenses totaling $80,300.

She sued Harvick Hauling and Harvick, alleging negligence and vicarious liability. Suit claimed that Harvick failed to maintain a proper lookout, a proper speed for conditions, and an adequate distance. The plaintiff did not claim lost income.

The jury awarded more than $1.4 million.
