Inadequate traffic control

March 2023

Truck driver Doe, 52, was traveling along Interstate 80 in Albany County, Wyo. While moving warning cones and signs for an ongoing highway improvement project, a laborer for Traffic Safety Services (TSS), who was driving a pickup truck attached to a trailer, crossed from the shoulder to the highway median, colliding with Doe. Doe suffered significant neck and back injuries, which led to four shoulder and fusion surgeries after conservative treatment failed.

Doe sued TSS; the project’s general contractor, Croell, Inc.; and the laborer, alleging liability for the collision. The plaintiff asserted that the project lacked necessary safety personnel, including two workers assisting with moving cones and signs plus an experienced traffic control person, rather than a seasonal laborer.

The parties settled for $4.5 million.
