Broken pavement on local highway

June 2024

Doe was riding his motorcycle on a local highway when he encountered an area of broken pavement. He lost control of the bike, hit a curb, and was ejected. He suffered orthopedic and internal injuries, which caused him to miss nine months of work.

Doe sued an undisclosed defendant, asserting that the pavement had deteriorated due to freezing and thawing conditions and that this area remained hazardous for motorcycle operators despite the state transportation department’s alleged attempts to patch potholes near expansion joints.

The parties settled the case for more than $1.12 million.
