January 27, 2022Doe, 55, was working on a highway construction project. After the workday had ended, the driver of a commercial pickup truck allegedly backed up several hundred feet in the work zone without visibility and ran over Doe, who was performing a task. Doe suffered fractures to his leg, ankle, ribs, and spine, which necessitated a long hospitalization. He now suffers from posttraumatic stress disorder and is unable to return to work. His past medical expenses totaled $259,000.
Doe claimed an undisclosed employer was liable for the injuries caused by the at-fault pickup truck driver. The defense argued that Doe’s claim was barred by his contributory negligence.
The parties settled for $600,000 before suit was filed.
