July 18, 2024Roe, an uninsured motorist, allegedly failed to yield the right-of-way and sideswiped fellow motorist Kekula Victorino, 35, whose vehicle was totaled. Victorino suffered back sprains and strains, a foot laceration, and a forearm abrasion. His injuries necessitated trips to the ER, urgent care, and visits to his primary care physician and a chiropractor. Despite physical therapy, he continues to experience pain in his lower back.
Victorino brought an uninsured motorist claim against Safeco Insurance Co., contending that Roe failed to yield the right-of-way. The claimant sought over $32,580 in medical expenses and approximately $1,000 in lost income.
The claimant was awarded $100,000.
