Default on promissory note

Stevens & Soldwisch Oil and Gas Properties, LLC, executed a promissory note with a principal amount of $515,000 plus interest and delivered it to Pete McClintock. Frank Stevens also executed a member guaranty, under which he was to personally guarantee payment on the note. Stevens & Soldwisch paid only $29,400 on the loan.

McClintock sued Stevens & Soldwisch and Stevens, alleging claims for default, reformation, and personal guaranty.

The court awarded $485,000, plus interest.
