Assault and battery

Early one evening, Denis Zenchenko, 30, and his brother went to a Dunkin’ Donuts to purchase drinks. As the two were waiting for their order, Miguel Gonzalez brutally assaulted Zenchenko with a knife in an unprovoked attack. Zenchenko underwent emergency surgery and suffered severe blood loss. He required a lengthy rehabilitation and was confined to his home for a period. Zenchenko, whose medical expenses were approximately $50,000, now lives with functional limitations.

Gonzalez pleaded guilty to assault and battery.

Zenchenko sued Gonzalez and West Side Donuts, Inc., which operated and controlled the Dunkin’ Donuts, alleging negligence.

The jury awarded $215,000.
