Breach of contract by uninsured motorist carrier

Tawanna Graham, 56, was driving on a multi-lane roadway when a vehicle traveling in the opposite direction crossed into opposing traffic and struck her car almost head-on. Although the collision was low-impact, Graham suffered neck sprains and connective-tissue injuries to her lower back and right knee and thumb. She also suffered emotional distress, which prevents her from driving or continuing her work as a security guard. Her medical expenses were approximately $11,600.

Her uninsured motorist carrier, State Farm Insurance Co., offered $11,654 of coverage, which Graham rejected.

She sued State Farm, alleging breach of contract. Suit did not claim lost income.

The jury awarded $1 million, which was reduced to $100,000.
