Defamation

February 27, 2020

Brian Fernalld, 60, worked as a vice president of operations for Abb Inc. After allegedly being directed to replace the company’s older workers with younger employees, he complained to Abb management, including his boss, Lewis Noddin, and his wife, Laura Noddin. Subsequently, Laura Noddin falsely accused Fernalld of sexually assaulting her at a company event. The Noddins allegedly spoke about this alleged assault to people within the company as well as outside the organization. As a result, Fernalld suffered damage to his reputation.

Fernalld sued Laura Noddin, alleging defamation. She countersued, alleging battery.

The jury awarded Fernalld $550,000 on his defamation claim and also found in his favor on the counterclaim.

Citation: Fernalld v. Abb Inc., No. 06-2016-CA-016854 (Fla. Cir. Ct. Broward Cty. June 12, 2019).

Plaintiff counsel: Chris Kleppin and Chelsea Lewis, both of Plantation, Fla.
