Failure to heed right of way

July 11, 2019

As Yinyan Guo was driving through an intersection, Rebecca Delaney’s SUV turned left from the opposite direction, striking the driver’s side door of Guo’s sedan. Guo, 23, suffered a fractured left hip, necessitating open reduction and internal fixation surgery. She also suffered a postoperative DVT and required blood thinners and an IVC filter. The following year, she required revision surgery to address hardware issues, and she still experiences pain in her leg after running or jogging. Her medical expenses were more than $52,900.

Guo sued Delaney, alleging failure to heed the right of way at the intersection. The plaintiff asserted that the defendant had made a left turn on a yellow light after a larger vehicle in front of her turned, and that the defendant failed to pause before executing her own turn.

Suit did not claim lost income.

The jury awarded more than $552,900.
