Failure to maintain fitness center bathroom

February 27, 2020

After undergoing back surgery, George Kleeman, 75, was using the therapy pool at the Advocate Good Shepherd Hospital Health and Fitness Center. He entered the family changing room and slipped on the wet tile floor. The fall caused him to suffer a fractured right hip, necessitating a total hip replacement. Kleeman’s medical expenses were more than $164,700.

Kleeman sued Advocate Health & Hospitals Corp., alleging its failure to maintain the changing room led to the accumulation of water on the tile floor. The plaintiff asserted that the defendant had been on notice that water was accumulating on the floor but failed to provide safety mats, safety railings, or warning signs.

The jury awarded more than $214,700.

Citation: Kleeman v. Advocate Health & Hosps. Corp., No. 2016-L-008823 (Ill. Cir. Ct. Cook Cty. June 5, 2019).

Plaintiff counsel: AAJ members James P. McKay and Philip P. Terrazzino, both of Chicago.
