Failure to maintain railing at sports arena

Aaron Friedman, 8, and his parents attended a hockey game at Webster Bank Arena. Before the game, Friedman and other children leaned on a railing in order to “high five” the players as they took to the ice. The railing on which Friedman was leaning gave way, causing him to fall and strike his head on the floor five feet below. He suffered a traumatic brain injury. Now 13, he has been diagnosed with post-concussive syndrome, which interferes with his ability to sleep and learn, among other things.

Friedman’s parents, on his behalf, sued the arena’s operator, alleging failure to properly secure the railing and ensure the safety of arena patrons. The plaintiffs argued that the defendant had encouraged young fans to lean on the railing to greet the players but failed to maintain it.

The jury awarded $200,000.
