Failure to pay no-fault benefits
April 10, 2020Scott David suffered injuries, including a closed-head injury, after being hit by a car in a parking lot. He filed a claim for no-fault benefits with his insurer, Farm Bureau General Insurance Co., seeking to recover more than $450,000 for outstanding medical bills plus costs incurred for household replacement services, lost income, and attendant care. The insurer denied payment for more than three years, accusing David of fraudulent misrepresentation regarding his injuries and the facts surrounding the incident.
David sued Farm Bureau, alleging it wrongfully failed to pay him no-fault benefits. The plaintiff asserted that although the defendant had never attempted to obtain his statement regarding the claim, it disputed the facts of the incident and the nature and extent of his injuries. The plaintiff also sought statutory penalty interest.
The jury awarded nearly $685,200.
