Failure to protect infield players at baseball facility

Doe, a professional baseball pitcher in his early 20s, went to the Roe indoor sports facility, which has a regulation-sized baseball infield but no outfield. While practicing pitching to his friend between second and first base, Doe was struck by a ball that was hit by a member of a group taking batting practice. Doe suffered a right orbital fracture, which left him with double vision, floaters, and the need for cataract surgery. Although he initially returned to baseball, he was unable to continue due to his vision issues.

Doe sued the sports facility, alleging it failed to protect infield players during batting practice. The plaintiff asserted that the defendant should have run a screen to protect infield players and also should have instructed the batting group to use soft tosses only. The plaintiff did not claim lost income.

The parties settled for a confidential amount.
