Failure to yield while turning left
March 12, 2020Devon Roach entered an intersection and attempted to turn left. He collided with an oncoming vehicle, in which Teena Brailsford, 57, was riding. Brailsford suffered severe injuries, including a cervical fracture at C6, which necessitated surgical decompression. She also suffered a fractured rib and sternum, a dislocated thumb, and abrasions to her hips and leg. Brailsford now requires a walker to ambulate and has difficulty getting dressed. She also suffers from nerve damage that causes her to experience a burning sensation on her skin.
Brailsford sued Roach, alleging that he failed to yield while turning. The defense stipulated as to negligence but disputed causation.
The jury awarded $1.7 million, including $1.1 million for the plaintiff’s past and future medical expenses.
