Unauthorized removal of fallopian tube
May 9, 2019Doe, 27, was admitted to a hospital to undergo a cesarean section and resection of a right ovarian cyst. Roe gynecologist removed Doe’s left fallopian tube, although Doe had not consented to the procedure. Doe subsequently learned that her right fallopian tube was nonfunctioning and that any future pregnancies would require her to undergo expensive in-vitro fertilizations.
Doe sued Roe and the hospital, alleging liability for the unauthorized sterilization procedure. Suit did not claim past medical expenses or lost income.
The parties settled for $400,000. Roe paid $350,000, and the hospital paid $50,000.
