Issues: (1) Whether the district court correctly held that Plaintiffs plausibly alleged a claim that relates to sexual harassment, triggering application of the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021 (EFAA).
(2) Whether the district court correctly held that all of Plaintiffs’ causes of action relate to the same conduct, such that all Plaintiffs’ claims fall under the EFAA and cannot be compelled to arbitration.
