Amici Letter from Consumer Attorneys of California and the American Association for Justice in Urging the Court to Grant Review

 

AAJ joined the Consumer Attorneys of California (CAOC), California Employment Lawyers Association, and the National Association of Consumer Advocates in support of plaintiff’s appeal asking the Supreme Court of California to reverse the lower court’s dismissal for lack of standing. The letter brief was authored by AAJ Amicus Curiae Committee member David M. Arbogast. However, the Supreme Court of California denied the petition for review and request for depublication on January 25, 2023.

 

Issue: Whether the Fair Credit Reporting Act and similar consumer protection laws require a plaintiff to prove they suffered a concrete injury to recover statutory damages.
